Terms & Conditions of Participation

The contractual frame for working together.

§ 1 Scope & provider

These General Terms and Conditions of Participation govern the contractual relationship between Mag. Markus Weigl, MSc Coaching (MWCC Markus Weigl Consulting & Coaching e.U.), Schlossgasse 30, 2100 Stetten, Austria („the provider") and clients, participants and commissioning parties („participants"). They apply to all contracts initiated and concluded via markusweigl.at or in personal contact, for the following offerings:

  • The Threshold Retreat
  • One-to-One Accompaniment (incl. couples accompaniment)
  • Conscious Leadership (confidential sparring & Leadership Retreat)
  • Contemplative Practice (DAO, Qi Gong, Taoist energy work)

§ 2 Conclusion of contract

The contract is concluded by written or electronic confirmation of the booking by the provider. The participant receives a confirmation that summarises the essential contractual contents (offering, fee, time frame, terms of cancellation).

§ 3 Right of withdrawal (consumers, distance contracts)

For consumers in distance contracts within the meaning of the Austrian FAGG, the statutory right of withdrawal of 14 days from contract conclusion applies. Withdrawal can be declared informally (e-mail to kontakt@markusweigl.at sufficient).

If, at your express request, performance has begun before expiry of the withdrawal period, a pro-rata fee is owed for services already rendered.

§ 4 Fee and payment

Fees and payment terms are agreed individually and named transparently in the initial conversation. Invoicing follows the contractual milestones (e. g. deposit, intermediate instalment, final instalment). Instalments are possible on request.

§ 5 Cancellation and rebooking (retreats)

For retreats, the following cancellation arrangements apply unless otherwise contractually agreed:

  • More than 60 days before start: cancellation fee 25 % of the package fee.
  • 60 to 30 days before start: cancellation fee 50 %.
  • Less than 30 days before start: cancellation fee 80 %.
  • No-show or cancellation on the day of start: 100 %.

If the participant names a replacement person of equivalent suitability and the provider confirms, no cancellation fee is incurred. Travel-cancellation insurance is strongly recommended.

§ 6 Professional distinction

The offerings are not psychotherapy, not medical and not curative treatment within the meaning of the Austrian Physicians Act. They do not replace these. The participant takes part on their own responsibility. Pre-existing illnesses, complaints or psychosocial crises must be disclosed before the start; the provider may refuse participation if the chosen format is unsuitable.

§ 7 Confidentiality

The provider is subject to professional confidentiality (§ 119 GewO 1994). All contents of conversations are treated in the strictest confidence. Confidentiality is broken only where legally required (e. g. serious endangerment of life and limb of participants or third parties).

§ 8 Liability

Liability of the provider for slight negligence is excluded to the extent legally permissible. Liability for intent and gross negligence remains unaffected. The provider's liability is in any case limited to the amount of the contractual fee for the affected offering.

§ 9 Place of jurisdiction, applicable law

Place of performance and place of jurisdiction is — to the extent legally permissible — Korneuburg, Austria. Austrian law applies, with the exception of its conflict-of-laws rules and the UN Convention on the International Sale of Goods. For consumers within the meaning of the KSchG, the statutory place of jurisdiction at their place of residence remains unaffected.

§ 10 Severability

Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by an effective provision that comes economically closest to the intended one.
